The owner of these mineral rights has 25.82 net mineral acres, or 50% of the 51.64 gross acres in the tract.
These mineral rights are currently non-leased / non-producing. However, there is activity all over this area and they have had multiple leases in the past. There are currently 2 rigs running just North of this acreage. Securing a lease will provide the buyer with an immediate ROI, and given the activity in the area, it’s only a matter of time before this acreage is drilled on.
We have attached the last lease from 2018, which was a 5 year term and appears to now be expired. The owner was Larry Lynch at the time of that lease, but our client is Larry Lynch’s daughter. She has provided an AOH showing her as the only heir to Larry Lynch. In addition, she was able to provide some additional historical leases and deeds regarding the ownership.
Please note that the seller may have ownership in other locations of Nacogdoches. In addition, it’s possible she will inherit additional acreage in the future. The deed must be specific to only the 51.64 acre tract within A-17. In addition, the deed must only convey mineral rights within this tract that she currently owns as of the effective date, and she would keep any mineral rights she inherits in the future.
All bids should be based upon 25.82 NMA currently non-leased / non-producing status. Adjustments will be allowed in this case on the basis of what is proven in title. However, if you show less than 25.82 NMA, the deed will need to convey a specific amount of net mineral acres.
